BOOKING AGREEMENT
This Letter of Agreement outlines the terms and conditions for the license of:

SOUND RESTRICTIONS:
The venue has a strict decibel limit due to the nature of the location of the venue imposed by The Gold Coast City Council.
Studio 56 has a strict 98db (A) WEIGHTED noise restriction and at no time must this exceed.
The Laneway has a strict 103db limit average (A) WEIGHTED noise restriction and at no time must this exceed.
The venue reserves the right to monitor all sound levels during sound check and the event.
The venue reserves the right to cease the event if the levels are not adhered to.
By signing this agreement you acknowledge these restrictions and during the entire performance they will be abided by.
HIRE AGREEMENT:
$4.40 INC GST per head (1400 capacity) VERSES minimum guaranteed amount of $4000.00 INC GST
Whichever is the greater.

CANCELLATION POLICY:
IF for ANY reasons the ARTIST/CLIENT/REPRESENATIVEcancels the contracted booking date, the below cancellation fees will be charged to the ARTIST/CLIENT/REPRESENATIVE.
Please not these fees are due to the ‘pop up” nature of the venue we contract all production, staging, staff, security for all events.

If it is MORE than 2 months prior to the contracted booking date the following will occur:
If tickets are currently on sale you will be liable for any cancellation fees involved with OZTIX.
LESS than 4 x weeks out from the contracted booking date the following will occur:
$2000 cancellation fee will be charged. You will also have a separate invoice for any cancellation fees involved with OZTIX.

FORCE MAJEURE:
Miami Marketta will NOT be liable for any delay or failure to perform its obligation under the contract if such events are to arise:
(a) Act of God, fire, lightning, explosion, flood, war or military operations, insurrection or civil disorder, industrial dispute of any kind (whether involving Miami Marketta employees or contractors) inclement weather, government action, curtailment of travel services, public health order any other similar or dissimilar that is out of the control of the Miami Marketta (Venue).
SPECIAL CONDITIONS:
Miami Marketta holds no responsibility for methods of advertising and promotion for the Entertainment Booking.
All advertising and promotion for the Entertainment Booking is the responsibility of the Venue Hirer / Promoter / Artist
The venue will assist where possible with promotion of the event, with in house promotional support who will
assist to connect with your marketing team to ensure best possible exposure.
PRODUCTION:
Production is supplied by venue and contracted to Adam Biggs of Biggsounds.
Miami Marketta production manager is Max Annand || E. max@biggsounds.com.au
In-house spec sheet attached and House tech is included in the Venue Hire Fee.
Any extra specs will be a cost to the artist.
Biggsound provide a certified Crowd Control Barrier for patron and performer safety included in the Venue Hire Fee
BACKLINE
Needs to be provided by ARTIST at no cost to the VENUE.

GREEN ROOM
A Green room is provided which includes (Mirror, Fridge, Fans/Heater, First Aid, Seating). Both HEADLINER and SUPPORT will need to use this room (THIS will be confirmed prior to the day)
ALL greenrooms should be treated with respect. We try and look after our bands with drinks and food and expect that all ARTISTS treat it with love and respect.IF there is anything that the VENUE does not agree with the ARTIST will be asked to leave their GREENROOM by security.
RIDER
A food and drink rider will be provided by venue.
The venue offers an beverage rider of
- 1 x case of beer (Young Henry's, Stone and Wood, Coopers)
- Red or White Wine
- Assorted soft drinks and bottled water
- Tea and coffee facilities
- Towels/Mirror/Iron and Ironing Board
- Cups/wine glasses/napkins and cutlery
- Lounge and seating areas
- Cheese and Antipasto grazing board for arrival
Artists are Able to fashion their own rider, please send through requests so that we can quote prior to your event.
These riders will be at the cost to the ARTIST.
*SORRY no Wi-Fi is available in the GREENROOM. If Wi-Fi is needed we can assist in our office.
TICKETING
Miami Marketta is contracted to OZTIX as its exclusive ticketing service for ALL events held here.
Ticket prices for all shows are determined by the act / promoter and approved by venue. The advertised ticket price should include the $4.40 INC GST venue hire fee.
Oztix Booking Fees are charged as follows and this amount will be added on top of your Final NET Ticket price.
The Booking Fee comprises two parts, a flat fee plus 2% of the total value of the net ticket price and Booking Fee combined.
Net price and Booking Fee is then displayed to Customer as an ‘all-inclusive’ price.
The flat fee charged to Customer per Ticket including GST as follows:

TICKETING REFUND POLICY
If a ticket refund is required and approved by the ARTIST / HIRER, ARefund shall include the Net Ticket price only, exclusive of Booking Fees and any applicable SMS / Registered Post Delivery Fees. The Delivery Fee shall only be refunded if tickets have not been already mailed prior to refunds being announced.
Should the ARTIST / HIRER stipulate a full refund inclusive of Booking Fees and Delivery fees, theARTIST / HIRER agrees to reimburse Oztix the total amount of all chargebacks, booking fees, delivery and processing charges refunded to customer within fourteen (14) days of receipt of a valid tax invoice from Oztix detailing the refunded charges.
Oztix may also deduct the refunded charges from any settlement funds being held in the Oztix bank account on behalf of the venue / promoter / hirer.
MERCHANDISE
We encourage you to supply your own Merchandise seller for your event.
If you need Miami Marketta to supply a Merchandise person this needs to be notified at least 14 days prior to the event. And will be a fee of $25 p/h cash on the night.
You will need to supply your own float, extension cords etc. We can provide tables and chairs.
Venue would like to offer the artist to have the option of commission or gifting vinyl/tee merchandise to venues archives.
PAYMENT
OZTIX to split the settlement with the venue hire fee$4.40 INC GSTand release all other funds into the account of the client.
This will be emailed over for approval prior to the release of the funds.
PUBLIC STAGE WAIVER
By submitting this document you the ARTIST or REPRESENTATION of the ARTIST are responsible for any injury on stage to ARTIST or GUEST they choose to bring up on STAGE.
VENUE will not be responsible for any related injuries or deaths.
ARTIST will act respectively to the venue. Any damages that occur to the VENUE by ARTIST or GUEST of the ARTIST will be a COST to the ARTIST and representation of the ARTIST.
